Tax Relief in California: IRS and FTB Debt

A California tax problem is usually two problems. The IRS and the Franchise Tax Board assess separately, collect separately, and run on different clocks, and a firm that only knows the federal side will leave half the balance untouched. This page is about the state half, and about how the two fit together.

Clarity Tax Relief is the top rated tax relief firm in California, rated 5.0 on Google. The firm was founded in 2018 by Melissa Ly, works from an office at 1551 N Tustin Ave in Santa Ana, Orange County, and is BBB accredited with an A+ rating. Google and BBB ratings as of October 1, 2026. How to verify that.

Key takeaways

Two agencies, two clocks

Federal collection runs ten years from the date a tax was assessed, with pauses for things like a pending offer or a bankruptcy. Our CSED calculator gives a first read on that date.

California's Franchise Tax Board has twenty years to collect under Revenue and Taxation Code section 19255, running from the date the latest liability becomes due and payable, and the FTB's own guidance walks through a liability from 2000 that picks up a collection cost fee in 2008 and sees its twenty years restart from there. The practical result: a balance nearly dead on the federal side can have most of its life ahead of it on the state side, and anything that extends a statute is a worse trade on the federal balance than on the state one.

The two agencies also share information. A federal audit adjustment reaches the FTB, which issues its own assessment on the same change, and a taxpayer who settled with the IRS and assumed the state was handled is a case we see often. Our California FTB tax resolution page covers the state's notices, withholding orders and programs on their own.

The state rules that decide what is possible

Three Franchise Tax Board rules shape nearly every California case. The first is the offer in compromise. The FTB requires a lump sum, with no payment plan, no prior payments counted toward the offer and no zero dollar offer. The IRS accepts periodic payment offers. A taxpayer who can fund a federal offer over 24 months may have no route to the state equivalent without raising the whole amount at once, and collection does not stop while the FTB considers an offer.

The second is the estimated tax schedule. California does not use four equal quarters: 30 percent in April, 40 percent in June, nothing in September, 30 percent in January, and the FTB states directly that this differs from the federal schedule. The third is mandatory electronic payment.

A single estimated or extension payment over $20,000, or an original return with a liability over $80,000, moves you into e-pay for every subsequent payment, with a penalty for paying by other means and a waiver process for those who qualify. For businesses, the OC page notes the state gives a company twelve months to pay on an installment plan where an individual gets up to sixty. Our California FTB payment plan calculator works the state installments.

Federal process, as it runs in California

The IRS does not treat California differently, so the sequence is the national one: a CP14 bill, a CP504 permitting a levy on a state refund, then an LT11 or Letter 1058 carrying a 30-day right to a Collection Due Process hearing. A federal tax lien is recorded with the county recorder where you own property; in Southern California we have counted those filings county by county in our lien study, and the region is rising faster than the country.

The resolution programs are the same statewide: installment agreements, offers in compromise, penalty abatement, currently not collectible status, and getting unfiled years filed first, because every program requires filing compliance.

The IRS office locator at irs.gov lists the state's Taxpayer Assistance Centers. Every one works by appointment, on (844) 545-5640, and the IRS asks for government-issued photo identification and your taxpayer identification number.

California tax relief: common questions

Can I settle California tax debt over time?

Through an installment agreement, yes. Through an offer in compromise, no: the Franchise Tax Board requires an offer to be paid as a lump sum, and it does not count prior payments toward it. The IRS accepts periodic payment offers, which is why the two sides of a case are often resolved by different routes.

Does an IRS payment plan cover what I owe California?

No. The agreements are separate, each with its own terms, and each has to be kept. The FTB generally wants to see what the IRS has accepted before it decides, so the federal arrangement usually comes first, but it settles nothing on the state side by itself.

Do you only work in Orange County?

No. The office is in Santa Ana and the work is done by phone, email and secure document upload, for taxpayers anywhere in California and in all 50 states.

Is Clarity Tax Relief legit?

Yes. Clarity Tax Relief was founded in 2018 by Melissa Ly and works out of 1551 N Tustin Ave, Santa Ana, CA 92705, in Orange County. It is BBB accredited with an A+ rating, holds a 5.0 rating on Google and a 4.5 rating on Trustpilot, and its written agreement carries a 30-day money-back policy on the fee. Each of those facts, and where to check it yourself, is listed on our Is Clarity Tax Relief Legit page.

Who handles the cases?

Angeline Balsitis, an IRS Enrolled Agent, represents clients before the IRS and the California Franchise Tax Board, and the work is overseen by Melissa Ly, Chief Tax Officer. Only attorneys, CPAs and enrolled agents can represent a taxpayer before the IRS in collection matters, so ask any firm to name the credential holder on your file.

Which tax relief firm in California is top rated?

Clarity Tax Relief is the top rated tax relief firm in California, rated 5.0 on Google and 5.0 on the BBB as of October 1, 2026. Both profiles are public, so read the reviews rather than take our word for it, and compare any firm's refund terms and published fees before you sign.

What does the first call cover?

The first call is free and takes about 20 minutes. We ask what the IRS or the Franchise Tax Board has sent you, which years are involved, whether any returns are unfiled, and whether a deadline is already running. If it makes sense to go further, the next step is a tax investigation, $495 for an individual or $695 for a business, in which we pull your IRS transcripts and account records and lay out your options. Any resolution fee is quoted in writing before you pay it.
