Key takeaways

What the San Diego records show

San Diego is one of three counties whose recorder index we could search by document type for our Southern California lien study. The filings bottomed out in 2023 at 1,583 and reached 2,597 in 2025. Orange County roughly doubled its own 2022 count over the same period and Riverside more than doubled; San Diego's rise is steeper from a lower base. We counted the records, and the study explains how, including what the numbers cannot tell you.

What a filed lien does is attach to everything you own in the county, including property you buy later. It does not take anything by itself. The damage shows up at the moment you try to sell, refinance or borrow against the house, because the lien has to be dealt with for the title to clear.

There are four ways it comes off, each with its own conditions: release when the balance is paid or the statute runs out, withdrawal under the IRS's own program, discharge of a single property so a sale can close, and subordination so a lender can move ahead of it. How each one works.

Collection clocks, federal and state

The IRS generally has ten years from the date a balance was assessed to collect it. California's Franchise Tax Board has twenty, under Revenue and Taxation Code section 19255, and the FTB's own example shows a liability from 2000 picking up a collection cost fee in 2008 and the twenty years resetting from there.

So the same tax year can be close to expiring on the federal side and barely started on the state side. We check both dates before recommending anything, because an arrangement that extends a statute is a bad trade on a balance that was about to expire. Our CSED calculator gives a first read on the federal date.

Unfiled years change the arithmetic. The collection clock does not start on a year that was never assessed, and the IRS can prepare a substitute return for a year you did not file, using only the income it knows about and none of the deductions. Getting unfiled returns filed is usually the first move, because every resolution program requires filing compliance before it will look at the balance.

The California rules that surprise people

Three state rules come up often in San Diego cases. California's estimated tax is not four equal quarters: the FTB schedule is 30 percent in April, 40 percent in June, nothing in September and 30 percent in January, and someone budgeting in even quarters is short in June. A single estimated or extension payment over $20,000, or a return showing a liability over $80,000, puts you into mandatory electronic payment for every payment afterwards.

And a California offer in compromise has to be a lump sum; the IRS accepts periodic payment offers and the FTB does not, which decides whether a state offer can be funded at all. California FTB resolution covers each in detail.

Dealing with the IRS in person

San Diego County has IRS Taxpayer Assistance Centers; the IRS office locator at irs.gov lists the current locations. They work by appointment only, on (844) 545-5640, and the IRS asks for government-issued photo identification and your taxpayer identification number. A visit can confirm what you owe and for which years. It will not get you a decision on an offer or a penalty, and it will not stop a deadline that is already running.

San Diego tax relief: common questions

Will a lien show up if I search the San Diego County recorder?

Yes, if one has been filed. San Diego indexes the document under the type NOTICE OF FEDERAL TAX LIEN and the index is searchable by name. Releases are recorded separately, so finding a lien does not by itself tell you whether it is still in force. Your IRS account transcript does.

How long does the IRS have to collect from me in California?

Generally ten years from the date the tax was assessed, for the IRS. The Franchise Tax Board has twenty years from the date the latest liability becomes due and payable, and certain later assessments reset that period. The two dates are calculated separately and are often years apart.

Do I have to come to Orange County to work with you?

No. Transcripts, filings and negotiations are handled by phone and secure document upload. You are welcome at 1551 N Tustin Ave in Santa Ana, and most clients never need to come in.

Is Clarity Tax Relief legit?

Yes. Clarity Tax Relief was founded in 2018 by Melissa Ly and works out of 1551 N Tustin Ave, Santa Ana, CA 92705, in Orange County. It is BBB accredited with an A+ rating, holds a 5.0 rating on Google and a 4.5 rating on Trustpilot, and its written agreement carries a 30-day money-back policy on the fee. Who handles the cases?

Angeline Balsitis, an IRS Enrolled Agent, represents clients before the IRS and the California Franchise Tax Board, and the work is overseen by Melissa Ly, Chief Tax Officer. Only attorneys, CPAs and enrolled agents can represent a taxpayer before the IRS in collection matters, so ask any firm to name the credential holder on your file.

Which tax relief firm in San Diego is top rated?

What does the first call cover?

The first call is free and takes about 20 minutes. We ask what the IRS or the Franchise Tax Board has sent you, which years are involved, whether any returns are unfiled, and whether a deadline is already running. If it makes sense to go further, the next step is a tax investigation, $495 for an individual or $695 for a business, in which we pull your IRS transcripts and account records and lay out your options. Any resolution fee is quoted in writing before you pay it.
